
General Terms and Conditions (GTC)
Event: Wild Naya Handpan Academy including Accommodation
Organizer: Holistic Sound & Movement Association
1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts between the Holistic Sound & Movement Association (hereinafter referred to as the “Organizer”) and participants of the Wild Naya Handpan Academy.
By registering, participants acknowledge these GTC as binding.
2. Registration and Conclusion of Contract
Registration for participation in the Wild Naya Handpan Academy takes place online, in writing, or in another form expressly approved by the Organizer.
The contract becomes effective upon confirmation of registration by the Organizer.
Participation is only possible once the full participation fee has been received by the Organizer within the stated deadline.
3. Services of the Organizer
The Organizer offers workshops, lessons, concerts, and a supporting program focused on the Handpan.
The exact schedule, content, order of activities, and choice of instructors may be changed at any time by the Organizer.
Announced instructors may be replaced without notice. The cancellation of individual program items or instructors does not entitle participants to a refund or reduction of the participation fee.
In the case of unforeseeable global events (e.g., pandemics, natural disasters, governmental restrictions), the event may be held in digital form. By accepting these GTC, participants explicitly agree to this possibility.
4. Payment and Prices
Participation fees must be paid in advance and within the period communicated by the Organizer.
The prices valid at the time of booking apply.
Special rates (e.g., early-bird prices or supporter tickets) are available for a limited time only and valid exclusively during the stated booking period.
5. Refunds, Returns, and Ticket Transfer
Refund of the participation fee is generally excluded.
However, transferring the ticket to another person is possible. Such transfer is made at the participant’s own responsibility. The Organizer is not involved in the organization of transfers and assumes no liability for any resulting consequences.
Unused services – for example, due to late arrival, non-attendance, or early departure – do not entitle participants to a (partial)
refund.
6. Participant Conduct
Participants agree to behave respectfully, considerately, and responsibly toward others, instruments, nature, and all facilities used.
The use of illegal substances is strictly prohibited.
Alcohol may be consumed only in moderation. Disruptive, intoxicated, or inappropriate behavior may lead to immediate exclusion from the event – without any refund.
Participants must comply at all times with instructions from the Organizer and its staff.
7. Liability
Participation is at the participant’s own risk.
The Organizer is liable only in cases of gross negligence or intent. No liability is accepted in particular for:

Loss or damage of instruments or personal belongings

Health impairments, injuries, or illnesses

Weather-related changes or cancellations

Cancellation of program items or instructors

Theft, vandalism, or loss
Participants are responsible for their own adequate insurance coverage (e.g., health, accident, instrument, or liability insurance).
8. Withdrawal and Cancellation by Participants
Withdrawal from participation is only possible in writing (by email or letter). The date of receipt of the withdrawal notice by the Organizer is decisive.
A free withdrawal is only possible within 14 days of booking under the statutory right of withdrawal (if applicable).
After this period, no refund of the participation fee will be made – even in the case of non-attendance or early termination.
When transferring a ticket to a replacement participant, the name and contact details of the new participant must be provided immediately.
The Organizer assumes no costs for travel, accommodation, or other expenses incurred in case of cancellation or non-participation.
In addition to the event, rooms, parking spaces for vehicles, and camping pitches are offered for rent. The booking of these additional services is separate. Cancellations of these bookings are subject to the same conditions as the event participation, unless explicitly stated otherwise.
9. Force Majeure / Event Cancellation
In cases of force majeure (e.g., natural disasters, governmental orders, pandemics, or comparable events), there is no entitlement to a refund of the participation fee.
The Organizer may instead offer alternative dates or conduct the event digitally.
Participants have no right to withdraw or claim a refund in such cases.
10. Photo and Video Recordings
During the event, photo, audio, or video recordings may be made by the Organizer or by commissioned third parties.
By participating, participants consent to the free use of such recordings for documentation, publicity, and promotional purposes (e.g., website, social media, printed materials).
If participants do not wish to be recorded, a written objection must be submitted to the Organizer before the event begins.
11. Severability Clause
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall not be affected.
The invalid provision shall be replaced by a legally permissible regulation that most closely reflects the economic purpose of the original provision.
12. Applicable Law and Jurisdiction
Austrian law exclusively applies.
Place of jurisdiction is the registered office of the Organizer, unless mandatory legal provisions state otherwise.
Participant Declaration / Liability Waiver
By registering, I hereby declare:

I have read, understood, and accept the General Terms and Conditions (GTC) in full.

I participate in the Wild Naya Handpan Academy at my own risk.

I am responsible for my own physical and mental health as well as for my personal belongings and instruments.

I waive any claims against the Organizer, staff, or instructors in case of injury, damage, loss, or cancellations.

I explicitly accept that no refund will be made in the event of instructor cancellations, program changes, digital implementation, or force majeure.

I acknowledge that the event may be conducted online in case of extraordinary global circumstances.
13. Accommodation & Catering
The Organizer provides various accommodation options:

Camping and campervan pitches (participants must bring their own tent or campervan)

Single, double, or shared rooms
Allocation is based on availability and order of registration.
Only as many people may occupy a room as there are beds available.
Sanitary Facilities:

Showers and toilets are available in sufficient number, approximately a 5-minute walk from the camping and campervan areas.
Rooms:

Rooms are not pre-made. Bed linen and towels are provided on site; participants are asked to bring an additional towel.

Participants are responsible for making their own beds and removing bedding before departure.

Rooms must be left clean and in the same condition as they were found.
Liability for Damage or Unclean Conditions:

Upon occupying the accommodation, participants are liable for any damage they cause to furniture, equipment, or the premises. Damages must be reported immediately to the Organizer.

If the accommodation is not left in proper condition, a minimum cleaning/damage fee of €150 may be charged.
Use of the accommodation is at the participant’s own risk. The Organizer is not liable for the loss or damage of personal belongings or for damages caused by participants.
Catering
Catering during the event is provided by Nori Catering.
Participants must inform the Organizer of any allergies or intolerances as early as possible, but no later than July 1, 2026. This information will be treated confidentially and shared only with Nori Catering.
The Organizer assumes no liability for health impairments or damages resulting from unreported allergies or intolerances.
Cancellation and Substitute Participation
In case of withdrawal or non-attendance, no refund will be made for participation, accommodation, or catering fees – regardless of the reason.
Participation may be transferred to another suitable person, provided that the Organizer is informed in writing in advance and the substitute person meets all participation requirements.
It is strongly recommended to take out travel or ticket insurance to cover potential costs in the event of illness, accident, or other unforeseen circumstances.
Final Provisions
Austrian law applies. The place of jurisdiction, as far as legally permissible, is the Organizer’s registered office (Graz).
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall not be affected.
